TERMS & CONDITIONS SUBMISSION OF YOUR INITIAL PAYMENT INDICATES THAT YOU HAVE READ AND AGREED TO THESE TERMS. They are designed to be as clear as possible. The Accommodation: Back Brae Lodge, Tobermory, Isle Of Mull PA75 6PB http://www.backbrae.com The Owner: Ken Fraser 31/8 Parkside Terrace EDINBURGH EH16 5XP 0777 976 9003 info@musicscotland.com STANDARDS The Owner pledges to: * Describe accurately the services provided, on the Back Brae website and via email. * Ensure high standards of customer care and cleanliness are maintained at all times. * Deal promptly and courteously with all enquiries, requests, complaints and other feedback. * Provide proper insurance cover, and comply with all relevant legislation and regulations. The Owner will make every effort to ensure that you have an enjoyable and problem-free holiday. In the event that you are dissatisfied with the accommodation in any way, you should register this immediately with the Owner, before you have vacated the Accommodation if at all possible. The Owner will always take into account any feedback given regarding the Accommodation, for your benefit and for future guests. If you remain dissatisfied in any way, the Owner will endeavour to investigate any issue and offer a part-refund if considered appropriate. 'You', as referred to in these terms, refers to the person making the initial arrangements to book the Accommodation, or the person assigned as being responsible afterwards, with notice to the Owner. Holiday lets are defined as short-term lets extending to not more than 31 days, to the same person or persons, in any single year. OCCUPANCY The maximum number of overnight guests allowable in the Accommodation at any one time is FOUR ADULTS or THREE ADULTS WITH CHILDREN. The maximum number of beds available is THREE. Extra guests sleeping on floors are not permitted. The Owner reserves the right to take any appropriate action if guests are found to be in breach of this rule, including but not restricted to immediate termination of the booking and cancellation of any remaining booked nights, with a 50% cancellation charge depending on number of nights cancelled (pro-rata). You are solely responsible for Your whole residential party. The Accommodation may not be sub-let by You, nor can You transfer possession of the property during the rental period. The Owner reserves the right to refuse entry to the Accommodation at any time, to any person considered (by the Owner or his agents) unsuitable to reside or take charge, and to terminate the let if considered necessary. You must allow the Owner or his agents entry to the Accommodation at any time, for any necessary purpose. BOOKING The minimum booking period is three nights. Bookings by those under 21 years of age cannot be accepted. To secure a booking You should submit a deposit or full balance, providing all contact details, as requested. You should clearly indicate or confirm the dates required, and the total number of guests and beds required. Special needs or requests should also be communicated at this point, and the Owner will respond with details of any appropriate extra charge if necessary. Until this initial payment is received, the period will remain bookable by other parties. When Your initial payment has been received, You will receive a confirmation email containing the details of Your booking. You should check that these details are correct. PAYMENT For bookings made more than six weeks in advance, You are required to pay a £100 deposit. For bookings made less than six weeks in advance, full payment is required. If you have paid a deposit, Your balance payment for the let must be received no later than one calendar month before the date of commencement. You will be sent a reminder at this time by email and/or telephone, if the balance payment has not been received. The Owner reserves the right to treat the booking as cancelled after one calendar month before the date of commencement of the let, if no balance payment has been received after this reminder. Receipt of all payments will be confirmed via email, or by telephone if requested, with details on how to access the house on arrival. CANCELLATION & INSURANCE Any cancellation must be notified to the Owner immediately, by telephone or email, before the commencement of Your let. Your deposit payment of £100 is only returnable in the case where Your cancellation is more than one calendar month prior to Your original entry date, and on condition that the Owner can re-book Your period with another party. In this case, every effort will be made by the Owner to re-book. If the period is re-booked successfully, a refund of your deposit will be made to You within one week of the re-booking, minus a cancellation administration charge of £20. Your balance payment (over the £100 deposit) will always be returned in every case of Your cancellation. If Your booking period should become unavailable due to circumstances beyond the Owner's control (for example fire or weather), Your entire payments will be returned in full and, according to your preference, either the Owner will make every effort to find a suitable alternative property, or the Owner may offer You an alternative week at a discounted rate as compensation - You will have no further claim against the Owner in either case. You are recommended to take out holiday insurance, in case of cancellation. If the reason for cancellation falls within the terms of Your insurance policy, the above costs will normally be refunded by Your insurance company on receipt of a valid claim, subject to their conditions. ARRIVAL & DEPARTURE Unless otherwise arranged with the Owner, weekly holiday lets normally commence at 3.00pm on the Friday of Your first week, subject to unavoidable housekeeping delays, and end at 11.00am on the following Friday. For other booking periods, the same entry and departure times apply, unless arranged otherwise. Full arrangements should be made to depart the premises by the arranged time. You should ensure that the Accommodation is left in a reasonably clean and tidy condition. You will be liable for any costs incurred as a result of an unauthorised extension of your stay. SMOKING & PETS Smoking is not allowable within the Accommodation under any circumstances. There is a decked patio area just outside the upper entrance where guests can smoke. IMPORTANT - DOGS MUST BE RESTRICTED from the entire lower bedroom and upper sofabeds, as well as from all other soft furnishings, as they are likely to leave smells, or hairs which can cause allergy problems for other guests. There is a large lobby and drying room downstairs which can accommodate dogs comfortably - please bring bedding for them. Failure to apply these requests will result in pets not being accepted at Back Brae Lodge in future. You must bring suitable bedding for them, and they should not be left unattended in the Accommodation. You must confirm with the Owner regarding other pets. The Owner reserves the right to charge a £20 fee for extra cleaning of the Accommodation if these requests are not adhered to. BREAKAGES, LOSS & DAMAGE You bind and oblige yourself to pay the Owner in respect of significant breakage, loss or damage to any item in the house, beyond fair wear and tear. You must reimburse the Owner using one of the standard payment methods after your let has ended, at the cost determined by the Owner. Minor loss or breakages (eg small kitchen items) will not be pursued by the Owner. Significant loss or damage requiring immediate repair or replacement, and affecting guests in the following booking period, will be pursued by legal means if no adequate reimbursement is received. You are responsible for keeping the Accommodation fully secure with all doors and windows locked, when it is vacant during your booking period, unless otherwise arranged with the Owner. No items, fixtures or fittings should be removed from the Accommodation, left outside unattended or in wet weather. OWNER'S LIABILITY In so far as may be permitted by law, during Your stay at the Accommodation no responsibility will be accepted by the Owner or his agents for any injury, accident, damage, loss or theft regarding You or other persons, or property, other than in the case of the fault or negligence of either the Owner or his agents. The Owner will not be held responsible for any temporary or unexpected condition of the rented premises or its services (water, electricity) as a result of extreme weather conditions or other factors outwith its control. Due to the proximity of steep rocks, walls and steps, as well as low-level computer and TV equipment, the Accommodation is not recommended for toddlers aged one to four years. If you do have children of this (or indeed any) age, you are expected to take full responsibility for them. LEGAL The use of the Accommodation by You is according to the terms of Section 12(2) and Schedule 4, Section 8 of the Housing (Scotland) Act 1988, and any subsequent amendment. This means that the Accommodation is to be used for holiday lets only and may not be sub-let. Save as otherwise provided herein, these terms shall be governed by and construed in accordance with Scots law and the parties hereby prorogate the non-exclusive jurisdiction of the Scottish courts. PRIVACY STATEMENT Information requested by the Owner during the booking process will only be used for the purpose of providing You with the holiday, updating private records, or contacting You by email once every three months for feedback and promotional purposes.
